Dear LARA officials and Michigan Board of Medicine board members,
The New York Post published an article titled: Speakers at Detroit Jew-hating conference, including pair of terrorists, demanded Israel’s extinction: ‘need to be taken out’. The article reports in part: Nidal Jboor, Michigan-based doctor and anti-Israel activist, was among a bevy of speakers who openly called for the murder of Jews. “We all know who they are — whether they are in Israel, Tel Aviv, in Washington, in Germany, in Europe,” he said. “They need to be locked up. They need to be taken out. They need to be neutralized." The event called People’s Conference for Palestine was held in Detroit August 29-31.
Our country just experienced this past week the results hate driven public advocacy for political violence.
There must be strong consequences for people who spew hate that is intended to motivate violence toward segments of American society.
Under Michigan law, a doctor could face severe professional and legal consequences for publicly calling for the death of certain citizens, including the revocation of their medical license. Such an action would likely violate several existing laws and professional ethics codes, as a medical license does not protect a healthcare provider's free speech rights in a way that harms the public. The Michigan Public Health Code includes various provisions, including but not limited to Health Code, MCL § 333.16221, that would likely be violated by a doctor making such a statement.
Though a person does not "sacrifice their free speech rights when they get their medical license," those rights are not absolute. The state has a compelling interest in protecting the public from harm. In the case of a doctor calling for violence, a court would likely find that the state's interest in public safety and regulating the medical profession outweighs the individual's claim to protection under the First Amendment.
I urge you for public safety sake to initiate and fully execute an administrative complaint against Dr. Nidal Jboor for reportedly calling for the death of Jews.
Dr. Nidal Jboor’s medical license must be revoked to send the strongest message that such hate speech will not be tolerated.
